General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) govern orders placed on the golden-wine.ch website as well as the relationship between Golden Wine GmbH and its customers.

1. Seller's identity

2. Scope and acceptance

These GTC apply to any order placed on golden-wine.ch. Before confirming their order, the customer may consult these GTC, check the information entered and correct any errors. By confirming their order and accepting the GTC, the customer acknowledges having read and accepted them. The applicable version is the one in force on the date of the order.

3. Products and prices

The wines, champagnes and spirits offered on the site are presented with the greatest care. The photographs are intended to illustrate the products and may show slight differences in presentation. Prices are stated in Swiss francs (CHF) and include the applicable taxes as indicated at the time of the order. Any delivery costs are presented separately before the final confirmation of the order. The applicable price is the one displayed and confirmed in the summary at the time of the order.

4. Minimum age

Golden Wine reserves the sale and delivery of alcoholic beverages to persons who have reached the age of 18. By placing an order, the customer confirms that they meet this condition. Golden Wine or its delivery partner may request proof of age upon confirmation or handover of the order.

5. Order

Every order must contain a minimum of 6 bottles, with at least 2 bottles per reference, unless a special offer expressly indicates other conditions. Before validation, the customer has a summary allowing them to check the products, the quantities, their address, the payment method, the delivery costs and the total amount. After validation, an order confirmation is sent by email. Golden Wine may contact the customer personally in order to confirm their contact details, their selection and the delivery arrangements. In the event of the exceptional unavailability of a product or of a manifest error, Golden Wine contacts the customer in order to propose a suitable solution or the cancellation of the reference concerned.

6. Delivery

Golden Wine delivers in Switzerland to the address provided when ordering. Orders are generally delivered within 48 to 72 working hours after confirmation. Some regions may require a delivery time of 5 to 7 working days. The stated timeframes are indicative and may in particular vary depending on the destination, periods of high activity or circumstances beyond Golden Wine's control. Delivery costs are clearly indicated before the confirmation of the order.

7. Receipt of the order

On receipt, the customer is invited to check the condition of the parcel and the bottles. In the event of a damaged parcel, broken bottle, missing product or preparation error, the customer is invited to contact Golden Wine as soon as possible at contact@golden-wine.ch, attaching photographs where possible. Golden Wine will examine the situation and propose, depending on the case, a replacement, a credit note or a refund in accordance with the applicable rights.

8. Payment methods

At Golden Wine, no payment is made online. Depending on the method selected when ordering, the customer may pay on delivery by cash, bank card or TWINT, or after receipt by payment slip in 1, 2 or 3 instalments. Payment by payment slip in several instalments does not entail any increase in the price, any interest or any additional fee. The total amount of the order remains unchanged, whether the customer chooses to pay in 1, 2 or 3 instalments. The exact amounts and due dates of the instalments are indicated in the order summary, the confirmation email and the document sent to the customer.

9. Late payment

In the event of an unpaid instalment, Golden Wine may contact the customer and send them a reminder. If payment remains outstanding, Golden Wine reserves the right to undertake the steps provided for by the applicable legislation to obtain settlement of the sums due.

10. Complaints and defective bottles

Any anomaly concerning an order must be reported to Golden Wine as soon as possible. To facilitate handling, the customer is invited to provide their order number as well as, where useful, photographs of the product and its packaging. Where a defect is established, Golden Wine will seek an appropriate solution in accordance with the customer's rights.

11. Modification, cancellation and return

A request for modification or cancellation may be sent to Golden Wine as long as the order has not yet been dispatched. Golden Wine will do its best to act on it depending on the state of preparation of the order. After delivery, any return request must first be sent to Golden Wine and will be handled in accordance with the applicable legal provisions. An opened bottle cannot in principle be returned for a simple change of mind, subject in particular to an established defect in the product. The fact that Golden Wine allows payment after receipt does not exempt the customer from settling the products ordered and delivered in accordance with the order.

12. Liability

Golden Wine takes the greatest care in preparing and dispatching orders. Golden Wine cannot be held liable for a delay or an impossibility of delivery resulting from incorrect information provided by the customer, from an absence at the time of delivery or from an event beyond its control. The consumer's mandatory rights remain reserved.

13. Data protection

The personal data provided when placing an order is used to process the order, ensure delivery, communicate with the customer and provide after-sales service. Its processing is carried out in accordance with the Privacy Policy published on golden-wine.ch as well as with the applicable legal provisions on data protection.

14. Governing law and jurisdiction

Golden Wine GmbH is a company established in Germany and sells mainly to customers located in Switzerland. The mandatory provisions protecting consumers as well as the mandatory rules relating to the jurisdiction of the courts at the customer's place of habitual residence remain reserved.
